  • A KZN man has been sentenced to life imprisonment for raping a mother in front of her children.
  • The mother said she was fearful and depressed since the incident and was worried about the effect of the crime on her children.
  • Rapist Sihamandla Ntshingila also received four years for house breaking.

A KwaZulu-Natal man has been sentenced to life imprisonment after raping a mother in front of her children in Osizweni, the National Prosecuting Authority (NPA) said on Thursday.

Siphamandla Ntshingila, 43, was sentenced to life and four years imprisonment in the Madadeni Regional Court this week for the rape of a woman in the Osizweni area in November 2017, NPA spokesperson Natasha Kara said.

She said Ntshingila was also convicted of housebreaking.

In a victim impact statement, the woman said she was "fearful, depressed and could not sleep alone", said Kara.

"She also worries about the effect the crime may have on her children and siblings and feels ashamed."

Kara said that on the night of the crime, the victim was asleep in her home with her young children and her siblings when Ntshingila broke into her house.

"He raped her several times in the presence of the children and fled the scene. The victim could not identify him as the room was dark at the time, however, she reported the matter to the police and DNA samples were taken.

"The analysis of the DNA samples positively linked Ntshingila, as his samples were obtained from previous arrests. He was arrested a month later."

Kara said that during the trial, he raised the defence of consent, however, after cross examination by the Regional Court prosecutor, Eddie Mbewu "the court was convinced that Ntshingila did not know the victim and that the sexual intercourse was not consensual".

"Mbewu also led the evidence of the victim, the first report, as well as the DNA and doctor's report."
